Resolved Question: The house we were told we were taking over title to is going into foreclosure, is there a way we can save it?
My family and I moved into this house in May, it was supposed to be an “assignment of title” for us to buy. This “management” company said we can move in, pay $2000 in monthly payments to get the deed in our name, and we would then take over the mortgage. We’ve been making payments each month (into a bank account) that was supposed to cover the mortgage, homeowners insurance, and $80 each month towards the assignment of title fee. We did get receipts.

Well, we’ve been having problems communicating with them since August and just a couple of days ago got a letter in the mail from a lawyer which informed us the house is going into foreclosure in less then two weeks and with 4 small children we are under extreme stress right now. We’ve been trying unsuccessfully for months to contact the person whose name is still on the house with no luck, but managed to find him by locating a relative. We were able to meet up yesterday.Comparing notes with him, we found out that both us and the owner have been giving this “management” company money but they have never made a single payment to the mortgage company!

Both us and the owner want to file a lawsuit against this company, but in the meantime we have no place to go and no money saved up to pay 1st months rent and deposit to move somewhere else. Could there be a way to avoid foreclosure and get the mortgage in our name? Would it be possible for the owner of the house to file an injunction to stop foreclosure, and if so how can we do that?
We were scammed. The deed of trust was altered by this guy and he switched owner’s name to my wife’s name when I asked for some paperwork to show city public works.

We thought we were taking over the loan. I can track down all parties. We were told by the owner that the guy he paid and we paid drives two different Hummers. (or leases) Either way, he has a presence on the Internet and can be found.

* Hospital and jail visitation rights that were previously reserved for family members related by blood, adoption or marriage to the sick, injured or incarcerated person.

* Spousal insurance policies (auto, life, homeowners etc..), this applies to all forms of insurance through the California Insurance Equality Act (Cal. Ins. Code §381.5)
* Sick care and similar family leave
* Stepparent adoption procedures
* Presumption that both members of the partnership are the parents of a child born into the partnership
* Suing for wrongful death of a domestic partner
* Rights involving wills, intestate succession, conservator-ships and trusts
* The same property tax provisions otherwise available only to married couples (Cal. R&T Code §62p)
* Access to some survivor pension benefits
* Supervision of the Superior Court of California over dissolution and nullity proceedings
* The obligation to file state tax returns as a married couple (260k) commencing with the 2007 tax year (Cal R&T Code §18521d)
* The right for either partner to take the other partner’s surname after registration
* Community property rights and responsibilities previously only available to married spouses
* The right to request partner support (alimony) upon dissolution of the partnership (divorce)
* The same parental rights and responsibilities granted to and imposed upon spouses in a marriage

In my opinion:
Looks to me like domestic partnership is pretty much the same. Domestic partnership is a term used to describe same sex marriage in my eyes. Just like bigamy is the unlawful act of having two or more wives or husbands at the same time, usually with the second not knowing about the first. Polygamy is the practice of having multiple wives based on religious beliefs, with all wives aware of, and agreeable to, the husband having several wives. Civil unions, common law marriages, etc. are among these various terms used to describe different types of marriages.

In essence the comparison used with the Brown vs. Board of education “separate but equal” plight that gays try to use to compare their argument is not a fair comparison. Were gays being kept from attending the school of their chose just because they are gay? Were gays demanded to sit at the back of the bus or give up their seat because they are gay? Were gays hung on trees, blown up in churches, unable to vote just because they are gay? Were gays ever unable to drink from the “whites only” water fountain just because they are gay? Were gays forced to work as slaves because they are gay? The list goes on…THERE IS NO COMPARISON! Boundaries have to be created in order to establish some form of limit that keeps chaos from ensuing. The vote has been cast for a second time to establish what the majority wants (not just one race, but all walks of life were included in this vote). America doesn’t make it legal for genders of the opposite sex to commit bigamy, incest, statutory rape, etc. All these are acts that the members of the opposite sex can “want” to do, but can be arrested for doing. Are gays being arrest for their lifestyle? Looks like they have many rights granted to their situation already to suit much of what they want. Demanding the term marriage to include same sex marriage is forcing society to give a mile when many inches of fairness have already been granted.

Resolved Question: Does my old insurance company have the right to bill me AFTER my policy expires?
My homeowner’s insurance policy expired on March 1, 2008. After comparing rates I decide to go with another insurance company. I explained my situation with my former agent prior to the expiration date. Now my old insurance company wants to charge TWO MONTHS (through the end of May) of additional insurance which I did not agree to pay. They claim that I should have FAXed to my agent a formal letter stating that I was going with another insurance company. They are now demanding to see my current insurance declaration page to determine exactly when my present insurance became effective. They also threatening to send my bill to a collections company.

Why should I agree to this nonsense? They raised their rates and I went with another company. Why should I provide any information to my former insurance company? Insurance is not mandatory in life. It is only my business from who and when I purchase insurance.

Am I right or wrong? What would you do?

The term of my old policy was March 1, 2007 to March 1, 2008. I paid 100% of this amount. The question is for additional charges AFTER March 1, 2008.
What would be the worst thing that could happen if I tell them to take a hike?
1) I own my house – no mortgage here so it is in my right to decide whether or not I want insurance
2) My declaration page shows that the new coverage went into effect on March 14th.
3) If I faxed this page then I WOULD have to pay.
4) It is still none of their business.
