Resolved Question: What do I do Now, Sue again?
Okay, this is a question for all of you out there. I sued my condo association for mold and water damage inside my unit. We went to court and the judge during motions for limine made some bad rulings and instead of picking a jury and trying the case we are appealing the judges decision and did a bench trial for the damages inside and around my condo unit.
They agreed to fix and remediate the leaking roof, mold and exterior walls surrounding my unit. My insurance pays for the inside of course.

Now it seems that the common areas of the building have mold. So even if my condo unit is clear from mold I still can’t move back in because of the toxic mold in the elevator and other common areas of the entire building from my unit the penthouse duplex all the way down to the garage has toxic mold, structural damage to the wood framing.

So now what? We are appealing the inside of our unit having mold and discovery is already in for that.

But, isn’t this a new case due to the fact we didn’t sue them in the first complaint for mold in the common areas? or is it in the entire doctrine?
What can I do?

I am a cancer patient living outside my home for 2 years, I will probably now have no home to go back to ….
if you appealled a judges decision and your case is now going to that division and discovery is already in .. how does it all work?
Can you actually ammend it and take in new evidence and does discovery start all over again?

Resolved Question: We are in the process of mortgage loan and the lender has given us a computation of our would-be monthly?
payment. they included a monthly insurance payment worth $70.00 which is way too much for the condo unit that we are purchasing. It is 501 sq.f. and everything about the exterior (maintenance etc) including insurance is included in our HOA dues which amounts to $220. We informed our lender about the insurance being included in the HOA dues but they still added the $70. insurance in their computation. Can we choose our own insurance provider to insure the inside of our condo unit or are we tied up with what our lender decides for us?
Here in AK, our friend’s home is 2000 sq.f. but his monthly insurance payment is only $50.00 and it covers not only the interior but also the interior of his single detached home. Please share your opinions and i would be grateful for any professional input regarding this situation. THANK YOU SO MUCH!
hello, we got conventional loan. i am wondering, is this kind of insurance not required to close the deal? our closing date is may 22. because prior to moving in, we plan to do a lot of renovations and it may take a couple of months. we do intend to get insurance but would prefer to do so after the renovations. thank you!
