Open Question: HELP!!! Is my car may be totaled. I am not at fault & wondering how to handle insurance claims!?
I was recently in a wreck where a flatbed truck in front of me slammed on the breaks (and had no break lights), so I plowed into his car. The police officer checked his breaks and determined they were not working before the accident. I was not found to be at fault, and he was given a ticket for nonworking break lights.
The damage I have assessed includes: head light washers, bumper, hood, parts under hood (radiator and who knows what else), frame damage, frame of windshield loose/damaged, check engine light came on, and although no airbags deployed- the airbag light came on. Radiator fluid leaked all over the highway. The headlights are miraculously intact.
I am on pins and needles waiting to hear back from the repair/collision shop to see how much the damage estimate comes to. In the meantime I will need a rental car.
Since it is a foreign car, I would prefer Audi worked on the mechanical parts. Audi will need to supply the radiator (and whatever else is damaged under hood) as well as the paint, bumper, hood, (there is no way it can be fixed), and head light washers.
My same car model/year is being sold for $9,995; $9,495; $8,987; $8,900 in dealer listings on the Autotrader website. A year ago, when I bought it, it retailed at $10,000 from the dealer I purchased it from. Kelley Blue Book puts my car at $9,875 while NADA puts it at $8,950. I would be happy with any of these prices supposing it is totaled- because I could get a decent/comparable car. After being in a major accident, my car’s resale value will go down at least 40%.
Would his company’s insurance pay for all of this? Would it be better to try to see if my insurance company could pay for it and give his company a reimbursement claim? I could see myself getting better coverage if my company could pay for it (especially considering we have five cars insured with them as well as homeowner’s.

Open Question: Referring to my dependent relative who claimed himself instead of allowing me.?
Wondering how much I would benefit if he amended his taxes that shows he claimed himself to one that shows I can claim him. I am a single parent & have not filed yet.
My gross pay = 37,395. Fed Tx withheld =5146.31. SS tx withheld=2477.67. Medicare tx withheld = 579.00. NC State tx withheld=2273.
My bank’s Combined Tax Statement (interest income) for ’08 = 2,711
Purchased home on 9-19-08 for 164,000. Pd 79,195.00 down. Should get homeowners credit for 7,500.00.Mortage Interest pd=1319.00. Points paid = 2583.00. Homeowner’s insurance=753.00. Title fee=346. Excise Tx for purchase= 329.00. Attorney’s fee= 500.00
Have 4300. in a Roth IRA (none taken out).
Have 10,000 in Money Market for emergency only.
Deductions for myself and younger college son: Medical = 1713.00
I’m claiming my college son as a dependent. I should be “head of household” as I was last year.
College tuition / books 1142.00
My older son (age 28) is the one who filed & claimed himself & got a small refund with what little bit he made & blew it all. He has lived with me since his near fatal car accident in 2007 & and has lived with me all of 2008. I supported him 100% and paid ALL his expenses /debts/ even those in collections. I wanted to claim him for 2008 taxes but he filed, claimed himsef and collected his refund. His medical expenses I paid for in 2008 (that could have been deducted) was 8,218.00. I believe I could get about 3400.00 tax credit for each of my two sons.
I feel I lost a lot of money by him claiming himself but would like an idea. I really counted on that refund to pay property taxes, ext. Please estimate what my refund would have been if if I could have claimed him vs what I’ll get if I can’t. I’m going to talk with my acc’t soon, but would like to work something out with my son before hand. He doesn’t believe anything I say. Will it be worthwhile (based on data i gave) to have his tax status amended so I can claim him ? He is still recovering from brain damage and mental illness but not considered disabled so we can’t be too harsh on him.

Resolved Question: Homeowners Insurance?
I’m closing on my refi, and was just informed that my current company will not be insuring me any further(allstate). The reason? I had two claims filed in 08 and one in 06. So no one wants to insure me actually the one in 08 was a two for one we had a bad storm here in Chicago, and my room started leaking I spoke with my adjuster the next day. The day after that I noticed that a window had been badly damaged as well I called her back to inform and she told me that I would have to file a new claim for that. So the question is is there some company out there who would insure me one company said 8000.00 for the year(hell no) anyone have any ideas? Were still trying for my closing later this week.By the way I have contacted everyone else from state farm to geico and they say no way like im toxic or something
