Open Question: We had a fire at our Rental Home today. What’s next?
A cigarette started a fire at my rental home today. I was not home when this happened, so I cannot exactly explain how or why this happened (not to mention I don’t smoke). Needless to say, the fire damaged the deck as well as a small section of the side of the house. I called the landlord immediately after I received the call informing me of the fire and they explained to me that they will not be able to do anything until tomorrow. I have never dealt with a fire before, so I am absolutely clueless as to what comes next. I know I will find out the majority tomorrow, but I have a few questions.
1. Who is liable? Obviously I am the renter, but if I was not home, and I really at fault? The rear of our house faces a very busy road, so the cigarette could have come from that area, but my boyfriend also smokes. However, we weren’t home at the time, so I’m having a hard time believing he may have caused this. Is this something the owners home insurance covers?
2. I work for a Construction Company and could more than likely get the damage fixed at no cost to me or the owner. Is this something an owner would typically accept, or does this usually have to be handled through Insurance?

Overall, I am sick to my stomach over all of this. I want to get the damages fixed (obviously), whether or not I have to pay. Any information is greatly appreciated.

Resolved Question: Landlord/mold/lease – advice please?
My girlfriend and I moved into an appartment 4/9/09. Our landlord stated he would put installing new flooring in our bathroom. After numerous calls on getting it installed he finally had someone do it 4 months later. The installers found that the wood flooring was starting to rot from us taking showers and the floor having some water on it. We had a 6 month lease and about 2 weeks after he decided to fix the flooring we started packing up some things that we didn’t need to take to storage and found that there was a leak that was coming from the bathroom. We notified the landlord every week for several weeks. About 2 weeks ago after we had decided to resign our lease he sent 2 Mr. Fixits out to our house who said they couldn’t fix it. He then called a big company to come out and they determine what was causing the leak and found that when they did the flooring they never sealed the connections and most of them were leaking. The ceiling was so wet that most of it came down on my belongings. I don’t have renters insurance (only 21 didn’t really see the need) and I’m not even upset about the belongings. However im continously sick as is my girlfriend. There is mold in bottom corners of our room, in window sils, and in the closet where the water was leaking. The plumber had even said infront of our landlord when he came out to fix it that he would need to replace off the drywall. We have called and left messages for our landlord and haven’t been called back. What legal rights do I have? What steps should I take? I’m not after money, just out of the house (have a 6 month lease) and my rent and sec. Deposit back. Thank you in advance

Resolved Question: Are thier just too many problems with the apartment?
Ok, I just got a new job that trippled what I was making a month and I decided to upgrade my apartment. I searched around considering location, space, and price until I found this great deal. I found a two bedroom apartment on top of a garage for 450 a month in.luding city utilities. I said I”ll take it! Well we just went up this weekend to sweep the floors before we move in all of our stuff next weekend and we found that the previous owner had a pet and you can imagine what was on the carpet. We rented a carpet cleaner and cleaned all the rugs. But this was only one of many problems.
1. The foundation has some issues. The apartment sits on top of a double garage and the foundation that is sitting on the garage is rotted and falling apart (we spoke to the landlord who said he was fixing that asap)
2. Plug outlets in the house are loose and need replaced.
3. The back porch looks like its welting (another thing the landlord says he is going to fix)
4. My mother complained about a light in the shower and a wall that looked like it was leaning in the kitchen and how the floors were uneven.
There is no lease, We plan on buying rental insurance to protect our things. There are harsh winters in my area.
We decided that we arent buying the place and we can leave if the landlord does not fix things or the place falls apart so we are going to take it day by day.
QUESTION: Would you move in? Are their an legal issues you can think of? Should I type up a sort of lease and have both parties sign (what should I include in the lease?)

FriendFeed Just had a fire in my apartment building this morning. Came over here to survey the damage. No human or animal injuries. My cat is okay. Fortunately, there doesn’t seem to have been water or flames in my apartment. The main damage is from smoke, so I’ll have to replace a lot of fabric stuff. Any advice from anyone?
