Resolved Question: How to deal with HOA (Homeowner’s association) when pipe bursts, mold found?
I am a single woman, feel bullied and taken advantage of. Sewage pipe burst outside the walls of my unit and the association has readily admitted it is their responsibility to repair. They said mold was found as well. They are rushing things and scheduled repairs for tomorrow afternoon without me having any say in it asking me to live in a hotel with children, dog, have to eat out etc for at least 10 days which they are not going to cover at all. Is this the right thing to do? Do I not have the right to have someone inspect it from my side to make sure things are being done properly and is it fair that they don’t have to pay for my expenses of living in a hotel and eating out and housing my dog in a kennel? My insurance is covered through the HOA so I don’t have a separate policy so they are saying straight out that’s how it is. Please help I am lost and confused and can’t afford to stay in a hotel (don’t have friends or family to take us in either). This is in CA.
The fair housing department for my county said the civil code states the HOA should cover it. The HOA is saying their laws say they are not responsible. I called the HOA’s insurance co. which I am covered through and they are not returning my call, I left a vm for them.

I have mold on my walls and in my carpet. It took seven days to dry out the basement this past month.
It has rained heavily twice since. During very heavy rains, my neighbor’s side gutter creates a waterfall as the one rear drain pipe isn’t large enough to remove the water so she is installing a 2nd drain pipe at the front of the house. The work is supposed to be done this week.
But, the one drain pipe that is installed drains into a circular tube next to her house that goes underground. The underground piece doesn’t come out anywhere. I may be wrong, but I’m assuming it backs up because the rain can’t go anywhere, once it drains to the end of the pipe and hits the soil. During heavy rainstorms, the backed up water overflows the tube and it runs down 10 feet and creates waterfalls between my window wells and foundation. The water sinks through the ground on the side of my house and in my back yard. Most of it comes through my foundation where the wall mets the floor but some also comes in through the bottom of one window well. Someone is repairing that tomorrow. My concern is that the additional drain will not suffice.
I have walked throughout the neighborhood and noticed that many of the drains of this sort do empty out somewhere, but not all of them do.My neighbor thinks that once she has installed the second drain, this drain won’t overflow, but I’m not so sure.
Why are homes built with these drains that don’t empty out? Is there a name for these drains, so I can read more about them?
I have a large deductible on my homeowners insurance and I’ve never filed anything, so I don’t know how this insurance works. Whose insurance pays for my home repairs?
Also, every time it rains hard, I knock on my neighbors’ door and let them know that their water is flooding my yard and home. They don’t seem to know how to stop their drain from flooding into my yard. Any ideas as to how to temporarily stop this until they can arrange for repairs to this back drain?
They don’t seem all that interested in repairing the back drain. How should I arrange for this to occur if necessary? Should I just notify my insurance company and have it contact them or their insurance company?
Resolved Question: How long do you have to sue a home builder if your home has a major defect caused by the builders?
We had our home built in 2003, so we have been in it six yrs. now. Recently we discovered that there has been a very slow leak in one of the bathroom walls since the home was constructed. There was no evidence of this leak until recently, as this is a guest bathroom not used very much. The only time it would leak is when the shower was being used, which is rare. Apparantly, the builder’s workers pierced a pipe with a nail, causing a slow leak. Now, we have to have mold specialists come out and test the air for dangerous molds, then have a company clean up the mold, and of course there is the remodeling of the bathroom to do. This is going to come to thousands of dollars, which we do not have. We have also contacted our home owners insurance company, which will cover none of it, as # 1, they do not cover mold inspection or cleanup, and # 2, they will not cover the work to get to bathroom “put back together” because the leak was due to poor construction on the builders part. If there is anyone out there who is an attorney or who knows the law, I would appreciate and info. on our rights as homeowners. We are scared, not only of the possible mold issues, but scared of the cost, because as I mentioned before, we have no money to pay for this. At this point, we cannot even take a loan out for repairs and such, because we could not afford to repay the loan. I work, our two sons work, and my husband works two jobs just to get by. Please help with any useful info. if you can. Thank you!
