Resolved Question: Sue Insurance, Mortgage or both?
I am just if my parents are able to sue their homeowners insurance, mortgage company or both.
They bought a house 4 years ago and about 1 year ago it started going to hell. It needs a new roof, foundation is cracked all the way around and if it’s not taken care of it will cave in. Ceilings are ruined from water damage due to roofs, house is pulling away from foundation and the addition is seperating from the house. The basement was wiped out last year from water damage and the insurance company denied the claim. The basement was furnished. When we tore it apart there was so much mold and espestice it was unbelievable. The previous owners covered all of this stuff up and it was no noticable at all. So what’s your opinion on the situation? The mortgage company has the house set at 140,000 and it’s not even worth half of that in my opinion.
They had it inspected. When they replaced the carpet they noticed the house pulling away from foundation, when they tore apart the basement there were holes in and cracks in the middle of the foundation, which you would not have seen from outside, there was tons of mold and espestice which was also covered by paneling and ceiling. The roof, the morons that sold the house put shingles in the front and on sides but not the back, for curb appeal i assume.
My parents are not negligent nor stupid when it comes to repairs, the problem is the cost and i can pretty much gaurantee the stupid people that sold the house knew about these problems and covered it up to sell the house.
BY THE WAY, THE HOUSE IS ONLY 30 YEARS OLD!!!!!

Can homeowner request insurance damage reports to there unit?
I’m the owner of a Beautiful Condo in VA bottom floor, and the owner upstairs blew a water pipe and her hot water enter my unit through the ceiling for several hour, she could not stop the leak for hours. My tenants called me at approx. 7:00am VA time saying there is a serious emergency, water is leaking from the bathroom light fixtures. I’m in Hawaii, received this call 2-3 hour later, and Service Master were breaking my ceilings and sucking the water on my new floor. The next 2-3 days Service Master had fans and dryer in my unit, and replaced the ceiling without checking my electrical or plumbing.
Therefore, the upstairs owner caused damages to my new laminate flooring, bathroom ceiling, bedroom ceiling and maybe electrical problems within the walls. Can I request the insurance company for a damages report on my unit? Can I get electrical, flooring, structural engineer experts to make an assessments to my unit upon the damages. Take Notice, that I fully revitalized my whole unit only ten months ago. New paint, base and crown molding, flooring, closet, new kitchen/bathroom revitalization, Chandler/lights…etc. The insurance company made no sense, says she can’t give owners a copy of the damage report, I disagreed. I said under freedom of information act, FOIA can we request for the damages reports, its my unit, I’m the owner, I have rights. Right!! Please send a logical response only.
